M-KOPA Customer Privacy Policy

Please read this carefully as this policy is legally binding when you purchase our products and use our service.

At M-KOPA we take the privacy of our customers and their data very seriously. M-KOPA’s business model is premised on ‘upgrading the lives’ of our customers and we seek to ensure that our customers’ personal and device data is kept secure and used legally and in a transparent and fair manner.

This Privacy Policy (the “Policy”) is a key step along that journey.

The Policy explains:

  • How we collect, use, store, transfer and share your personal information (hereinafter referred to as “Processing” in relation to personal and device information).
  • How we process information related to your devices, (hereinafter referred to as “device information”).
  • Why we process your personal and device information.
  • What we need from you in relation to your personal information.
  • Your rights in relation to the processing of your personal information.

This Policy is available on our website at http://www.m-kopa.com and it applies to all M-KOPA group companies including, but not limited to, M-KOPA Kenya Limited, M-KOPA Uganda Limited and M-KOPA Solar Tanzania Limited.

M-KOPA DOES NOT SELL THE PERSONAL OR DEVICE INFORMATION OF ITS CUSTOMERS TO ANY THIRD PARTIES.

1. WHEN DOES M-KOPA COLLECT PERSONAL AND DEVICE INFORMATION?

We collect your personal and device information when you:

  • Sign up to purchase our products and services and fill out our customer registration form.
  • Respond to our know-your-customer screening questions.
  • Possess or use our devices.
  • Make payments to us.
  • Apply to us for employment.
  • Call or otherwise contact us including via SMS, USSD, website or an in-store visit to report a problem or discuss an issue.
  • Participate in market studies, surveys or promotions.
  • Participate in discussions on our social media platforms.

2. WHY DOES M-KOPA PROCESS PERSONAL AND DEVICE INFORMATION?

We process your personal and device information to gather data which is necessary for the performance of the contract which you will enter into with us. We may also process your personal and device information from time to time to enable us improve the quality of the devices and services that we offer and to offer you additional products and services.

In addition, M-KOPA is required to undertake know-your-customer (KYC) and due diligence measures so as to verify the identity of all customers that M-KOPA interacts with. Therefore, the processing of your personal and device information by M-KOPA so as to avoid instances of identity theft and to comply with anti-money laundering legislation is mandatory.

3. WHAT PERSONAL INFORMATION AND DEVICE INFORMATION DOES M-KOPA PROCESS?

We process the following information about you:

Information you give us when we enter into a contract:

  • When you purchase our products or services you provide us with your personal details in our customer agreement. These include your name, email address, occupation, birth date, gender, mobile number, national identity number (or other similar identification numbers as applicable), geographical location, photograph, and physical address.
  • When you purchase our product, we will also need additional KYC information from you such as your daily income/purchase potential or any information needed to comply with the terms and conditions of our contract with you, for the service.

The collection of the above information is mandatory. The failure to freely consent and provide any of the above-listed information would prevent us from entering into an agreement with you and would prohibit us from providing any products or services to you.

b) Information we collect about you from the continued use of our products and services:

  • We process the payments you make to us and your account information when using our services.
  • We process your overall account balance and payment history.
  • We process your information when you call or otherwise contact us via SMS or USSD, website or an in-store visit to either report a problem or discuss an issue.
  • We process your location when analyzing your device performance, and during repairs and replacement of the products and services, and while investigating fraud.

The collection of the above information is mandatory. The failure to freely consent and provide any of the above-listed information would prevent us from entering into an agreement with you and would prohibit us from providing any products and services to you.

c) Information from our website:

If you visit our website we may collect information about you to distinguish you from other users and to improve your experience. Please review the cookies policy on our website.

d) Information from third parties:

  • We process information about you that we receive from third parties including Credit Reference Bureaus, Mobile Network Providers, Data and Analytics Firms, Business Process Outsourcing Firms and Financial Institutions.

We process the following information about your devices:

e) Information obtained from analytic tools in our products:

  • We process information related to your devices including temperature settings, battery life, SIM communications and performance, and customer usage.
  • We may process information from your M-KOPA Televisions including viewing history, channel availability and signal strength.

4. HOW DOES M-KOPA PROCESS MY PERSONAL INFORMATION AND DEVICE INFORMATION?

We process your personal information for the following purposes:

  • To carry out our obligations relating to your contract including communicating with you, providing you with our products and services under our contract and related information.
  • To develop your credit profile and determine your eligibility for additional products and services that we may offer from time to time.
  • To communicate with you about any delinquencies in payments. To investigate cases of fraud or illegal activity.
  • To improve, test, and monitor the effectiveness of our products and services.
  • To develop and test new features and notify you about changes to our services.
  • To improve the safety and security of our services.
  • To comply with any applicable legal and/or regulatory requirements.

We may also combine the information we receive from third party sources with the information you give to us and the information we collect about you. We may use this information and the combined information for the purposes set out above (depending on the types of information we receive).

We process information about your devices for the following purposes:

  • To develop your credit profile.
  • To activate or de-activate your device depending on its credit status.
  • To monitor and investigate whether your device is being used in accordance with our terms and conditions found on our website and in the relevant product manual.
  • To investigate cases of fraud or illegal activity.
  • To monitor device performance including battery performance and charging information for the purposes of troubleshooting, data analysis, testing, research, statistical and survey purposes.
  • To analyze customer usage in order to improve efficiency of the device features.
  • To determine use location information to tailor our services according to the needs of a specific location.

5. DOES M-KOPA SHARE MY INFORMATION WITH THIRD PARTIES?

We may share your information with selected third parties including:

  • Business processing outsourcing firms including those handling customer care, customer communications and payment collections.
  • Credit reference bureaus and other similar third parties offering credit scoring information, including reporting your credit histories with such parties.
  • IT service providers including Software developers, platform providers or cloud providers.
  • Data processing firms, analytics firms or search engines to help us analyze our customer data.
    Academic or research institutions.
  • Other business partners, suppliers and sub-contractors for the performance and execution of any contract we enter into with them or you.
  • Advertisers and advertising networks to market products and services to you.
  • Other affiliated entities within the M-KOPA group of companies.
  • Any person or entity who invests in or finances (or may potentially invest in or finance), directly or indirectly, M-KOPA, and any of such person’s affiliates, officers, directors, employees, professional advisers, auditors, insurers or insurance brokers, service providers, partners and any delegate, agent, manager, administrator, nominee, attorney, trustee or custodian of any such person.
  • When required by law, regulation, court order or other court proceedings.

6. WHAT HAPPENS TO MY PERSONAL INFORMATION IF THERE WAS A CHANGE OF CONTROL?

If we sell or otherwise transfer part or the whole of M-KOPA or our assets to another organization (in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information may be among the items sold or transferred. The buyer or transferee will have to honor the commitments we have made in this Policy.

7. HOW DO WE STORE AND TRANSFER YOUR PERSONAL INFORMATION AND DEVICE INFORMATION?

  • The personal information and device information that is collected through the provision of our services may be stored and processed in any country in which M-KOPA, its affiliates or service providers maintain facilities, subject to the requirements of any applicable laws.
  • By using the services and as part of our customer agreement, you consent to the transfer, storing or processing of your personal information and device information to any country in which M-KOPA, its affiliates or service providers maintain facilities. In these cases, we ensure that both ourselves and our service providers take adequate and appropriate technical, physical and organizational security measures to protect your personal information and device information and the use and disclosure of your personal information and device information as described in this policy.
  • We use appropriate, reasonable safeguards to help keep your personal information and device information secure. We also take reasonable steps to verify your identity before granting you access to the service. As you will know, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data during transmission, and any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.
  • 8. HOW LONG DO WE KEEP YOUR PERSONAL AND DEVICE INFORMATION?

    We store your personal information and device information for the duration of your repayment period. This period can be found on your customer agreement. Once your device has been re-paid or upon the termination or deactivation of your account, M-KOPA, its affiliates, or its service providers may retain your personal and device information for as long as is required under applicable law in order to determine your eligibility for additional products or services, to perform analytics and help improve future product offerings and services or otherwise for backup, archival, and/or audit purposes.

    9. PROFILING AND AUTOMATED DECISION MAKING

    As part of being a highly technical and innovative company, we may use Automated Decision Making (ADM) in order to improve your experience or to help fight financial crime. For example, so that we can provide you with fast and efficient services, we may use ADM to verify your identity documents or to confirm the accuracy of the information you have provided to us. None of our ADM processes have a legal effect on you.

    10.YOUR RIGHTS

    Subject to applicable data privacy laws:

    • You have the right to correct any personal information we hold on you that is inaccurate, incorrect, or out of date.
    • You have the right to request that we stop processing your personal information if this processing causes or is likely to cause unwarranted substantial damage or distress.
    • You have the right to request that we stop processing your personal information for direct marketing purposes.
    • You may have the right to confirm which of your personal information we possess and to request the identity of any third parties who have access to this information.
    • You have the right to request that any decision which significantly affects you is not based solely on automated decision making.

      12. CHANGES TO OUR PRIVACY POLICY

      M-KOPA may modify or update this policy from time to time, so please review it periodically. We may provide you additional forms of notice of modifications or updates as appropriate under the circumstances. Your continued use of our products and services after any modification to this policy will constitute your acceptance of such modification.

Sheria na masharti yafuatayo ya ufadhili wa bidhaa (humu inajulikana kama “Masharti ya Fedha” kama inavyosasishwa mara kwa mara) yanatumika kwa Bidhaa zote za M-KOPA. 1. UFAFANUZI

1.1. Masharti haya ya Fedha hutumia masharti fulani ya herufi kubwa ambayo pia hutumiwa katika Mkataba wako. Maneno yoyote ya herufi kubwa ambayo hutumiwa katika Masharti haya ya Fedha na ambayo hayajafafanuliwa vingine yana maana sawa katika Mkataba. Kwa mfano, maneno kama Bidhaa, Malipo ya Kwanza, Ada ya Mkopo ya Kila siku na Bei ya Jumla ya Ununuzi zina maana sawa wakati zinatumiwa katika Masharti haya ya Fedha na Mkataba wako. Masharti haya ya Fedha pia yana masharti yafuatayo ya ziada yaliyofafanuliwa:

1.1.1. “Akaunti” inamaanisha akaunti ya wateja wa M-KOPA inayotumiwa kwa madhumuni ya kupokea malipo ya Malipo yako ya Kwanza na Ada ya Mkopo ya Kila siku.

1.1.2. “Additional Product” inamaanisha bidhaa yoyote unayonunua baadaye au unayonunua bora.

1.1.3. “Gateway Product” inamaanisha Bidhaa iliyonunuliwa na wewe ambayo inaweza dhibiti Bidhaa moja au zaidi za ziada.

2. LIPA ADA YA MIKOPO

Unakubali kulipa ada ya mkopo ya kila siku, kila wiki au kila mwezi (au mapema ukichagua) na unakubali kuwa ada ya mkopo ya kila siku itatumika kuelekeza mkopo wako wa M-KOPA, hadi utakapolipa Bei ya Jumla ya Ununuzi katika kiwango cha juu cha malipo kama ilivyoainishwa katika Mkataba. Zaidi ya hayo, unakubali kwamba Ada ya Mkopo ya kila siku inaweza kubadilika ukinunua Bidhaa za Ziada.

3. NJIA YA MALIPO

Malipo ya Kwanza na malipo yote ya ada ya mkopo (ikiwa yafanywa kila siku, kila wiki, kila mwezi au mbele kabisa) kuelekea ununuzi wa Bidhaa na / au nyongeza yoyote ya Bidhaa itafanywa kupitia:

Nchini Kenya- M-PESA Lipa Nambari ya Muswada 333222.
Nchini Uganda- Kwa MTN: Piga *165#. Kwa Airtel: Piga *185*44#
Nchini Nigeria- Deni ya moja kwa moja iliyoidhinishwa kwa M-KOPA.

Hakuna malipo ya pesa taslimu yatakubaliwa na M-KOPA wala haipaswi kufanywa kwa hali yoyote ya ununuzi wa Bidhaa zoyote au malipo ya Mkopo wa Ada wa Kila siku. Tafadhali julisha Huduma za Mteja wa M-KOPA mara moja ukiombwa kufanya malipo ya pesa taslimu.

Zaidi ya hayo, unaelewa kuwa M-KOPA inatoa fedha kwa Bidhaa. Unakubali na uelewe kuwa sehemu ya Ada ya Mkopo na Bei ya Jumla ya Ununuzi inajumuisha ya gharama zinazohusiana na Bidhaa na gharama za kutoa fedha kwa Bidhaa. Unaelewa ya kuwa unaweza wasiliana na M-KOPA ili kupata maelezo zaidi juu ya gharama hizi tofauti.

4. PUNGUZO LA MALIPO YA MAPEMA NA KIWANGO CHA RIBA KUZIDI (AMBAPO HUSIKA)

Unaelewa kuwa kwa kila mwezi unalipia Bidhaa yako mapema, utastahiki punguzo la bei (“Punguzo la Malipo ya Mapema”) katika kiwango cha kila mwezi kilichowekwa katika Mkataba. Unaelewa zaidi kuwa kwa kila mwezi umechelewa kulipia Bidhaa yako, unaweza kulipiwa malipo ya riba kwa malipo yanayostahili kulipwa kwa kiwango cha kila mwezi kilichowekwa katika Mkataba hadi Ada ya Juu ya Mkopo ya Kila siku sitini (“Riba Iliyopitiliza Kiasi”). Unaelewa marejeleo ya Ununuzi Jumla Bei inamaanisha Bei ya Jumla ya Ununuzi kama inavyobadilishwa na Punguzo la Malipo ya Mapema au Kiasi cha Riba cha Kuchelewa, kama inavyotumika katika Mkataba wako.

5. UTEKELEZAJI WA BIDHAA NA RIPOTI YA MIKOPO

Ikiwa unashindwa kuweka sasa kwenye malipo yako ya Ada ya Mkopo, M-KOPA inaweza kuzima Bidhaa yako hadi utakapoweza kuendelea na malipo yako ya Ada ya Mkopo. Hii inaweza hitaji malipo ya zaidi ya mmoja ilikufungulia Akaunti yako. Ukinunua Bidhaa ya Ziada na unashindwa kuendeleza malipo ya Bidhaa kama hiyo ya Ziada, M-KOPA inaweza kuzima Bidhaa yako ya Ziada na Bidhaa asili (hata ikiwa umelipa Bei ya Jumla ya Ununuzi Bidhaa yako asili) hadi utakapoendeleza malipo yako ya Ada ya Mkopo. Hii inaweza kuhitaji malipo ya zaidi ya mmoja, ilikuwezesha kufungua Akaunti yako.

Kuongezea, ikiwa utashindwa kuendeleza malipo ya Ada ya Mkopo kwa Bidhaa, historia ya mkopo inaweza kuripotiwa kwa ofisi ya kumbukumbu ya mkopo hadi uweze kulipa ada za mkopo.

6. HAKI ZA UTAWALA ZA M-KOPA JUU YA BIDHAA YAKO

Unaelewa kuwa M-KOPA itakuwa na haki fulani za usimamizi juu ya Bidhaa yako ambayo itaruhusu M-KOPA kuzuia matumizi na uwezekano wa kulemaza Bidhaa ikiwa Ada yako ya Mkopo haikulipwa au Akaunti yako iko nyuma. Kwa kuongezea, unaelewa kuwa haki hizi za usimamizi zinaweza kuamilishwa hata ikiwa umelipa Bei ya Jumla ya Ununuzi kwa Bidhaa ikiwa utanunua Bidhaa za ziada au huduma kutoka M-KOPA.

Unakubali kutojaribu kubadilisha haki za usimamizi zilizopewa M-KOPA juu ya Bidhaa na jaribio lolote la kufanya hivyo linaweza kubatilisha dhamana ya Bidhaa na kukiuka haki miliki za M-KOPA na mtengenezaji wa Bidhaa husika.

7. NIA YA UTUMIZI PEKEE

Bidhaa zote zitatumika tu kulingana na maagizo yaliyotolewa katika miongozo husika ya maagizo ya Bidhaa na mikataba ya leseni ya mtumiaji wa Bidhaa (inapobidi). Kwa kuongezea, Bidhaa yako inapaswa kudumishwa katika hali inayofaa ya kukarabati na kufanya kazi na unakubali kwamba ikiwa utakiuka maagizo yoyote yaliyotolewa katika miongozo ya Bidhaa, itasababisha kupotea kwa dhamana ya Bidhaa.

8. MABADILIKO YA BIDHAA

Usichezee (ikiwa pamoja lakini lakini sio mwisho, kubadilisha au kuondoa nambari ya bidhaa au alama zingine za kitambulisho cha Bidhaa), kufungua, kubadilisha haki za utawala, kubadili mhandisi, kutumia vibaya au kurekebisha na/au kutumia Bidhaa kwa njia nyingine yoyote; au kusaidia mtu mwengine kukiuka maagizo haya hairuhusiwi. Ukiukaji wowote wa sharti hili utasababisha kupotea kwa dhamana ya Bidhaa, batili haki yoyote ya kurejeshewa pesa na kusababisha ukiukaji wa kimsingi wa Mkataba. Kwa kuepusha mashaka ubadilishaji wowote na/au marekebisho ya moduli ya mawasiliano ya GSM katika Bidhaa hizo zitakuwa uharibifu wa makusudi wa mali ya M-KOPA na inaweza kusababisha mashtaka ya jinai na vitendo vingine vya kiraia vinaletwa dhidi ya mtu yeyote, iwe wewe mtu wa tatu, aliyegundulika kuwa umekarabati na/au kubadilisha Bidhaa bila kujali kama Bei ya Ununuzi Jumla ya Bidhaa imelipwa.

9. MAELEZO YA MAWASILIANO

Unakubali kwamba M-KOPA itatuma mawasiliano ya elektroniki kwa maelezo ya mawasiliano yaliyotolewa katika Mkataba. Unawajibika peke yako kwa usahihi wa habari kama hiyo na lazima uhakikishe kuwa habari zote za mawasiliano zilizopewa M-KOPA ni kamili na sahihi ili kuruhusu M-KOPA kuwasiliana na wewe au Mtu Mbadala wa Kuwasiliana wakati wa saa nzuri kuhusu akaunti yako ya M-KOPA . Unakubali kuijulisha M-KOPA juu ya mabadiliko yoyote kwa habari ya mawasiliano wakati wa Mkataba.

10. BIDHAA ILIYOPOTEA, KUIBIWA AU KUHARIBIKA

Unakubali kuwa hata kama Bidhaa yako itapotea au kuharibiwa nje ya dhamana, kwamba utawajibika kulipa Ada ya Mkopo na Bei ya Ununuzi Jumla ya Bidhaa yako.

11. UMILIKI WA BIDHAA

Unaelewa kuwa unamiliki Bidhaa wakati unanunuliwa lakini M-KOPA inamiliki umiliki wa mali yoyote na miliki yote ambayo hutumiwa kuendesha Bidhaa na data inayotokana nayo, katika hali zote mbili hata baada ya Bei ya Ununuzi Kulipwa.

12. KIKWAZO KWA BIDHAA

Unathibitisha na hauahidi kuuza na kuweka Bidhaa hiyo mbali na madai ya mtu mwingine yeyote au kutoka kwa kiambatisho cha kisheria, na haitaondoa, kuahidi, kukabidhi au kuchaji Bidhaa hiyo au kuunda kizuizi kingine chochote wala kuruhusu uwongo wowote kujitokeza juu yake hadi Bei ya Ununuzi Jumla ilipwe.

13. UTEUZI

Unakubali kuwa hautahamisha au kupeana haki au majukumu yoyote chini ya Mkataba bila idhini ya maandishi kutoka M-KOPA. M-KOPA ana haki ya kuhamisha au kupeana Mkataba au haki yoyote au wajibu chini ya Mkataba wakati wowote na kwa utekelezaji wa Mkataba huo, unakubali mgawo huo wa M-KOPA wa haki au majukumu yoyote ndani yake, mradi tu uhamishaji haubadilishi haki zangu na majukumu yangu chini ya Mkataba ili kukudhuru.

14. UKAGUZI

Unampa M-KOPA, wafanyikazi wake au wakala vifaa vyote vya kutosha na fursa ya ukaguzi wa Bidhaa ikiwa ni pamoja na lakini sio mwisho wa kuhusiana na huduma zozote za ukarabati au kuchunguza matumizi yoyote yasiyoruhusiwa ya Bidhaa wakati wa muda wa Mkataba.

15. KURUDISHA BIDHAA

Unaelewa kuwa unaweza kurudisha Bidhaa yako ikiwa katika hali nzuri na inayofanya kazi kwa ofisi zilizosajiliwa za M-KOPA, maduka ya rejareja au wauzaji wetu waliohitimu, wakati wowote na salio la mkopo wako linaweza kutolewa. Kwa kuongezea, M-KOPA inaweza kurudisha Malipo yoyote ya Asili kwa Bidhaa yoyote ambayo imeidhinishwa kurudishiwa na kurudishwa kwa utaratibu mzuri wa kufanya kazi kwa maduka ya rejareja ya M-KOPA, vituo vya huduma au wauzaji waliohitimu kama ifuatavyo:

16. DHAMANA

M-KOPA itatengeneza au kubadilisha Bidhaa, kulingana na masharti ya udhamini yaliyotolewa na mtengenezaji wa Bidhaa. Udhamini ni halali tu ikiwa Bidhaa inatumiwa kama ilivyoagizwa na haibadilishwi, kufunguliwa, kurekebishwa na / au kutumiwa kwa njia zingine ambazo hazijaidhinishwa na M-KOPA.

Kipindi cha udhamini ni kama ilivyoainishwa katika mwongozo wa maagizo ya Bidhaa husika. M-KOPA ina haki ya kukubali Bidhaa yoyote ambayo inarudishwa chini ya dhamana. Idhini kutoka kwa huduma ya wateja wa M-KOPA inahitajika kabla Bidhaa inaweza kurejeshwa kwa kituo cha huduma cha M-KOPA au duka kwa ukarabati au uingizwaji.

17. MAJUKUMU YA M-KOPA

1. Taarifa ya idhini
M-KOPA itawasiliana nawe idhini yake au kutokubali Mkataba kwa SMS, barua pepe au simu ndani ya siku 7 baada ya kupokea Mkataba huo.

2. Anzisha Bidhaa
M-KOPA itahakikisha Bidhaa imeamilishwa mara tu Malipo ya Asili yatakapopokelewa na, baada ya hapo, wakati wowote Akaunti yako ya M-KOPA ikiwa na usawa mzuri wa mkopo. M-KOPA haitakubali uwajibikaji ikiwa Bidhaa haipati mkopo kwa sababu ya mfumo wa mtu wa tatu au kukatika kwa mtandao ambayo inasababisha kutofaulu kwa kifaa kupokea mikopo.

3. Umalizaji Kulipa wakati Bei ya Jumla ya Ununuzi imelipwa
M-KOPA itakamilisha malipo ya Bidhaa na kumaliza mahitaji mengine ya Ada ya Mkopo mara tu Bei ya Ununuzi wa Bidhaa itakapolipwa. M-KOPA ina haki ya kuanzisha tena na kudumisha moduli na malipo kwa Bidhaa zozote za Ziada ambazo unaweza kununua.

4. Kinga Takwimu

M-KOPA inakubali kulinda data yako kwa mujibu wa sheria zilizopo za ulinzi wa data na ulinzi wa watumiaji isipokuwa inahitajika kutangaza habari hizo kwa sheria au kwa mujibu wa Masharti haya ya Fedha na Sera ya Faragha.

5. Umiliki wa Carbon Credits

M-KOPA atakuwa na umiliki kamili na wa kipekee wa mikopo ya kaboni iliyopatikana kutokana na matumizi ya Bidhaa.

6. Ufungaji wa bidhaa za jua

M-KOPA itafundisha mawakala wake jinsi ya kusanikisha Bidhaa za jua na itathibitisha kuwa Bidhaa za jua ziko katika hali nzuri ya kufanya kazi wakati wa ufungaji na uthibitisho wako. Ambapo unachagua kusanikisha Bidhaa ya jua peke yako bila msaada wa kisanidi kilichothibitishwa na M-KOPA, utawajibika kwa utunzaji wowote wa uzembe unaosababisha kutofaulu kwa Bidhaa ya jua kutekeleza kama inavyotarajiwa. Hii ni pamoja na uharibifu wowote au kuvunjika kwa shida wakati wa ufungaji.

7. Wasiliana

Iwapo una maswali yoyote, malalamiko, madai au mawasiliano mengine yanayohusiana na Masharti haya ya Fedha, yanapaswa kuelekezwa kwa wateja service@m-kopa.com.

8. Masharti ya Jumla

Hakuna kusamehewa kwa Masharti haya ya Fedha na M-KOPA utachukuliwa kuwa msamaha zaidi au kuendelea wa muda au hali hiyo au muda wowote au hali nyingine, na kutofaulu kwa M-KOPA kudai haki au kifungu chini ya Fedha hizi. Masharti hayatajumuisha kutoweka kwa haki kama hiyo au utoaji. Ikiwa kifungu chochote cha Masharti haya ya Fedha kinashikiliwa na korti ya mamlaka inayofaa kuwa batili, haramu, au isiyoweza kutekelezeka kwa sababu yoyote, kifungu kama hicho kitabadilishwa ili kuonyesha M-KOPA na nia yako au kuondolewa kwa kiwango cha chini kama kwamba vifungu vilivyobaki vya Masharti vitaendelea kwa nguvu kamili na athari.

Mkataba huu utasimamiwa na kufafanuliwa kulingana na sheria zinazotumika za mamlaka yako. Kwa kuepusha mashaka, mzozo wowote au madai yanayotokana nayo au yanayohusiana nayo, au mada au malezi yake (pamoja na mizozo au madai yasiyo ya mkataba) yatasimamiwa, na kufafanuliwa kulingana na:

  • Kenya- sheria za Kenya na mahakama za Kenya zitakuwa na mamlaka ya kipekee ya kusuluhisha mzozo wowote au madai ambayo yanatokana na au kuhusiana na mkopo kama huo au mada au malezi yake (pamoja na mizozo au madai yasiyo ya mkataba).
  • Uganda- sheria za Uganda na korti za Uganda zitakuwa na mamlaka ya kipekee ya kusuluhisha mzozo wowote au madai ambayo yanatokana na au kuhusiana na mkopo wowote au mada au malezi yake (pamoja na mizozo au madai yasiyo ya mkataba).
  • Nigeria- sheria za Jimbo la Shirikisho la Nigeria na korti za Nigeria zitakuwa na mamlaka ya kipekee ya kusuluhisha mzozo wowote au madai ambayo yanatokana na au kuhusiana na mkopo kama huo au mada yake au malezi (pamoja na mabishano au madai yasiyo ya mkataba).
